By visiting this website and/or purchasing one of our products, you agree to be bound by these General Terms and Conditions of Sale (the “Terms”). These Terms apply to all users of the website, including visitors, customers and buyers. By placing an order, you acknowledge that you have read and accepted them without reservation.
ARTICLE 1 — CONDITIONS OF USE
By accepting these Terms, you declare that you have reached the age of majority in your country of residence. Use of our products for illegal or unauthorised purposes is strictly prohibited. Our store is hosted by Shopify Inc., which provides us with the e-commerce platform that allows us to sell our products and services to you.
ARTICLE 2 — PRODUCTS
Odelà offers a collection of earrings and piercing jewellery, designed to fit naturally into everyday life with elegance and personality. Descriptions and images on the website are provided for information purposes. We do our best to display the colours and images of our products as accurately as possible, but we cannot guarantee that your screen reproduces the actual colours exactly. Odelà reserves the right to change its collection, descriptions or prices at any time without notice.
Gold-plated earrings are made of ASTM F136 titanium plated with 18-karat gold (IP process). The small part of the post hidden under the butterfly back during plating may show the bare titanium, which is darker. This characteristic, stated on the product pages, is inherent to the manufacturing process, affects neither the quality nor the durability of the plating and does not constitute a manufacturing defect. These provisions do not limit the statutory guarantees of conformity and against hidden defects enjoyed by the customer.
ARTICLE 3 — ORDERS
To place an order, customers must be at least 18 years old and provide complete and accurate information. An order summary is presented before final confirmation.
Payment constitutes firm and final acceptance. The order can no longer be modified or cancelled once confirmed. Customers are invited to check their cart and delivery details carefully before confirming.
Odelà reserves the right to refuse or cancel any order in the event of incorrect information, stock issues or suspected fraud. Any claim relating to an order must be made within 30 days of the invoice date.
ARTICLE 4 — PRICES & VAT
Prices on the website are shown in euros, including all taxes, with French VAT at the applicable rate. Odelà reserves the right to change its prices at any time. Products are invoiced at the price in force when the order is confirmed.
ARTICLE 5 — PAYMENT
Payment is made online using the payment methods offered at checkout (bank card and other methods available through Shopify Payments). Payment information is encrypted and secure. If payment fails or is declined, the order is automatically cancelled.
ARTICLE 6 — DELIVERY
Preparation and shipping times
Orders are prepared and shipped within 24 business hours of payment confirmation. This time may be longer during periods of high demand or due to external events beyond our control. Once shipped, orders are delivered by La Poste within 3 to 5 business days in mainland France. For international deliveries, times are given for information only and may vary by country. Exceeding them does not give rise to any compensation or cancellation.
Shipping costs
Shipping costs are €3.99 for mainland France. Shipping is free for orders of €60 or more in mainland France. For deliveries outside mainland France (French overseas territories and international), specific costs apply and are shown at checkout. Orders to French overseas territories and countries outside the European Union may be subject to customs duties and dock dues, which are entirely payable by the customer.
Delivery address
Products are delivered to the address provided by the customer when ordering. No change of address is possible after payment is confirmed. In the event of an address error attributable to the customer, reshipping costs may be charged. A tracking number is provided upon shipment. Odelà cannot be held responsible for delays attributable to the carrier or in cases of force majeure (strikes, pandemics, bad weather, etc.). After 30 days from the order date, the customer can no longer claim a parcel that has not been received.
ARTICLE 7 — RETURNS & EXCHANGES
Our return policy is valid for 30 days from the date of receipt. After this period, no return, refund or exchange will be accepted.
Eligibility conditions
To be eligible for a return, the item must be unused, in its original condition, returned in its original packaging and sent with a tracking number. No claim can be made for a parcel returned without tracking.
Returns will not be accepted in the following cases:
- Item used, damaged or incomplete for a reason not attributable to Odelà
- Return made more than 30 days after receipt
- Parcel that does not allow the order or sender to be identified (name, first name, order number)
- Item purchased as part of a bundle promotion and returned on its own — the complete set must be returned to obtain a full refund; if only part is returned, the items kept will be charged at the non-discounted unit price
- Item declared as returned but missing from the parcel received
The customer is solely responsible for the contents of the returned parcel. If a parcel is received containing fewer items than declared, only the items actually received will be taken into account.
Return procedure
To start a return, fill in the return form available on our website, stating your order number and the items concerned. Items returned without a prior request via this form cannot be accepted. Returns are free for a defective item or for an exchange for another item; in other cases, return costs of €4.50 (France) or €6.50 (other countries) are deducted from the refund. We recommend using a tracked service, especially for any item worth more than €10. Odelà cannot be held responsible for the loss of or damage to a return parcel.
ARTICLE 8 — REFUNDS
Upon receipt and inspection of the returned item, we will send you a confirmation email. If approved, the refund is made within 14 days to the payment method used for the order.
Returns are free for a defective item or for an exchange for another item. In other cases, return costs of €4.50 (France) or €6.50 (other countries) are deducted from the refund.
If you have not received your refund on time, first check your bank account, then contact your card issuer, then your bank. If the problem persists, write to us at contact@odelabijoux.com
ARTICLE 9 — INTELLECTUAL PROPERTY
All content on the website (texts, images, photographs, logos, brand names) is the exclusive property of Odelà and protected by intellectual property law. Any reproduction, even partial, without prior written permission is strictly prohibited.
ARTICLE 10 — PERSONAL DATA
The collection and processing of your personal data are governed by our Privacy Policy, available on our website. By placing an order, you agree to the processing of your data in accordance with this policy and the General Data Protection Regulation (GDPR).
ARTICLE 11 — LIABILITY
Odelà undertakes to make its best efforts to ensure the availability of the website and the proper performance of orders. Odelà cannot be held liable for indirect damage or service interruptions resulting from the use of the website, nor for non-performance due to force majeure.
ARTICLE 12 — PROHIBITED USES
It is prohibited to use the website or its content for illegal purposes, to infringe the rights of third parties, to distribute offensive or malicious content, or to attempt to compromise the security of the website. Any breach will result in immediate termination of access to the Service.
ARTICLE 13 — GOVERNING LAW & DISPUTES
These Terms are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution before any legal action. Failing agreement, any dispute will be submitted to the exclusive jurisdiction of the competent court for Odelà’s registered office (Bayonne). In accordance with the French Consumer Code, the customer may also use a consumer mediation procedure.
ARTICLE 14 — CHANGES TO THE TERMS
Odelà reserves the right to modify these Terms at any time. The applicable version is the one published on the website at the time of the order. Continued use of the website after modification constitutes acceptance of the new terms.
